This Privacy Policy explains how Kanaries Data Inc. ("we", "us", or "our") collects, uses, shares, and retains information when you visit vizgpt.ai (opens in a new tab) or use vizGPT and related websites, tools, and services (together, the "Services"). This Policy should be read together with our Terms of Use (opens in a new tab). By using the Services, you acknowledge the practices described in this Policy. If you do not agree with this Policy, please do not use the Services.

1. Information We Collect

The information we collect depends on how you use the Services. It may include:

• Account information. Your email address, name, profile picture, and authentication details when you create an account or sign in, including when you sign in through a third-party provider such as Google.
• Content you submit. Prompts, messages, uploaded files, images, videos, data sets, and other material you submit to the Services ("Inputs"), and the content the Services generate in response ("Outputs"), together with related project, chat, and generation history.
• Payment and billing information. Plan, purchase, subscription, invoice, and Credit records. Payments are handled by our third-party payment processor. We do not store full payment card numbers on our own systems.
• Usage and device information. IP address, browser and device type, operating system, referring pages, pages viewed, features used, clicks, errors, performance data, approximate location derived from IP address, and similar information collected automatically when you use the Services.
• Cookies and similar technologies. Cookies, local storage, and similar technologies used to keep you signed in, remember preferences, measure usage, and measure advertising performance (see Section 5).
• Communications. The content of emails and other messages you send us, such as support requests, feedback, and account requests, and our replies.

Please do not submit sensitive personal information, such as health information, government identification numbers, or financial account numbers, in prompts, uploads, or other Inputs unless it is necessary for your use. If you choose to submit it, you do so at your own discretion.

2. How We Use Information

We may use the information described above to:

• Provide, operate, and maintain the Services, including processing your Inputs and generating Outputs.
• Create and manage accounts, authenticate users, and provide customer support.
• Process payments, manage subscriptions and Credits, and handle billing questions and refund requests.
• Monitor, troubleshoot, secure, and improve the Services, including reviewing Inputs, Outputs, and logs to diagnose problems, evaluate quality, and develop new features.
• Understand how the Services are used and measure the performance of our marketing and advertising.
• Send you service-related messages and, where permitted, product updates and marketing communications. You can opt out of marketing emails at any time.
• Detect, prevent, and investigate fraud, abuse, security incidents, and violations of our Terms of Use.
• Comply with legal obligations, resolve disputes, and enforce our agreements.
• Create de-identified or aggregated information, which we may use for any lawful purpose.

3. How We Share Information

We may share information in the following circumstances:

• Service providers. With vendors that help us run the Services, including cloud hosting, database and file storage, authentication, payment processing, email, analytics, session analytics, customer support, code execution sandboxes, and web search tools. These providers process information on our behalf.
• AI model providers. When you use AI features, your Inputs and related context are sent to third-party AI model providers, directly or through model routing services, so they can generate Outputs. These providers process information under their own terms and policies.
• Advertising partners. With advertising platforms, for limited purposes such as measuring whether an ad led to a sign-up or purchase, as described in Section 5.
• Legal and safety reasons. When we believe in good faith that disclosure is required by law, subpoena, or other legal process, or is necessary to protect the rights, property, or safety of us, our users, or others.
• Business transfers. In connection with a merger, acquisition, financing, reorganization, sale of assets, or similar transaction, or in preparation for one.
• With your consent or at your direction. For example, when you choose to share a link to your content.

We do not sell your personal information for money. Some laws define "sale" or "sharing" broadly enough to include certain advertising and analytics activities. Section 5 explains the choices available to you.

4. Data Retention and Account Deletion

We keep information for as long as your account is active and as long as reasonably necessary for the purposes described in this Policy, including to comply with legal, tax, and accounting obligations, resolve disputes, prevent fraud and abuse, and enforce our agreements.

Deleting your account. To request deletion of your account, email support@vizgpt.ai from the email address associated with your account. We will respond to your request within forty-five (45) days of receiving it, or within any shorter period required by applicable law. Where reasonably necessary, taking into account the complexity and number of requests, we may extend this period as permitted by applicable law, and we will let you know if we do. We may ask you for information to verify your identity or account ownership before we act on a request. Deleting your account ends your access to the Services and to any content stored in it.

Information we keep after deletion. Even after your account is deleted, we retain:

• Emails and other communications between you and us.
• A record of your account deletion request and of the deletion.
• Payment, transaction, and billing records, as required for tax, accounting, and legal purposes.
• Information we are required or permitted to keep by law, or that we reasonably need to keep for security, fraud prevention, dispute resolution, or enforcement of our agreements.
• Copies that remain in backups or logs until they are overwritten or deleted in the ordinary course.
• De-identified or aggregated information.

Information that you have shared publicly, or that has been shared with third parties as described in Section 3, may not be removable by us.

5. Cookies, Analytics, and Advertising

We and our service providers use cookies and similar technologies for the purposes described in Section 1. These include:

• Analytics. Tools that measure page views, feature usage, and site performance.
• Session analytics. A third-party tool that records how visitors interact with pages, such as clicks, scrolling, and mouse movement, and produces heatmaps and session replays. We use this information to understand and improve the user experience.
• Advertising measurement. When you arrive at the Services from certain ads, a first-party cookie may connect that visit with later actions such as account creation, generation, downloads, and purchases, and we may send related conversion events to the advertising platform. Details, and a control to turn off advertising measurement for your browser, are on our Advertising privacy (opens in a new tab) page. For advertising measurement, we treat Global Privacy Control and Do Not Track signals as an opt-out.

Most browsers let you block or delete cookies. Some parts of the Services may not work properly without them. Except as described above for advertising measurement, the Services do not currently respond to Do Not Track or similar browser signals.

6. Security

We use reasonable administrative, technical, and organizational measures designed to protect information. However, no method of transmission over the internet or method of electronic storage is completely secure, and we cannot guarantee the security of your information. You are responsible for keeping your account credentials confidential.

7. International Processing

We are based in the United States, and our service providers may process information in the United States and other countries. These countries may have data protection laws that differ from the laws where you live. By using the Services, you understand that your information may be transferred to and processed in these countries.

8. Your Choices and Rights

Depending on where you live, you may have rights to request access to, correction of, deletion of, or a copy of your personal information, to object to or restrict certain processing, or to opt out of certain advertising-related processing. To make a request, email support@vizgpt.ai. Account deletion requests are handled as described in Section 4.

We may need to verify your identity before responding. We may decline or limit a request where permitted by applicable law, for example when we cannot verify your identity, when fulfilling the request would affect the rights of others, or when we must keep the information for the reasons described in Section 4. We will not discriminate against you for exercising your privacy rights.

You can unsubscribe from marketing emails by using the unsubscribe link in those emails. We may still send you service-related messages.

9. Children

The Services are not directed to children, and you must be at least 18 years old, or the age of majority where you live, to use them. We do not knowingly collect personal information from children under 13. If we learn that we have collected personal information from a child under 13, we will take reasonable steps to delete it. If you believe a child has provided us with personal information, contact us at support@vizgpt.ai.

10. Third-Party Services and Links

The Services may link to or integrate with websites and services we do not control, including sign-in providers, payment processors, and AI model providers. This Policy does not apply to them, and we are not responsible for their privacy practices. Please review their policies.

11. Changes to This Policy

We may update this Policy from time to time. We will post the updated Policy on this page and change the "Last Updated" date above. Changes take effect when posted unless we state otherwise. Where required by law, or where we consider it appropriate, we may provide additional notice. Your continued use of the Services after an update means you accept the updated Policy.
