Terms of Use for vizGPT

Effective Date: For users who first accept these Terms on or after 2026-09-30, these Terms take effect immediately. For all other users, they take effect on 2026-10-30.

Please read these Terms of Use ("Terms", "Terms of Use") carefully before using the vizGPT website and the vizGPT mobile application (together, or individually, the "Service") operated by Kanaries Data Inc. (opens in a new tab) ("us", "we", or "our").

Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who wish to access or use the Service.

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you do not have permission to access the Service.

1. Communications

By creating an Account on our Service, you agree to subscribe to newsletters, marketing or promotional materials, and other information we may send. However, you may opt out of receiving any, or all, of these communications from us by following the unsubscribe link or instructions provided in any email we send.

2. Purchases

If you wish to purchase any product or service made available through the Service ("Purchase"), you may be asked to supply certain information relevant to your Purchase including, without limitation, your credit card number, the expiration date of your credit card, your billing address, and your shipping information.

You represent and warrant that: (i) you have the legal right to use any credit card(s) or other payment method(s) in connection with any Purchase; and that (ii) the information you supply to us is true, correct, and complete.

We reserve the right to refuse or cancel your order at any time for reasons including but not limited to: product or service availability, errors in the description or price of the product or service, error in your order, or other reasons.

2.1 Plans, Credits, and Refunds

The Service is offered under a Freemium model. We may provide both free and paid plans, and each plan may include different features, quotas, limits, or access rights.

Certain paid features may be metered through Credits. If you upgrade to a paid plan and use any paid feature that results in Credits being consumed, we do not accept or process any refund request for that purchase, subscription period, or upgrade.

Except as required by applicable law, all payments are non-refundable. A refund may only be considered when both of the following are true:

• You email your request to support@vizgpt.ai within thirty (30) days after the date of the payment you want refunded. Payments made more than thirty (30) days before your request are not eligible for a refund.
• No Credits have been consumed after that payment.

Meeting these conditions makes a request eligible for review but does not guarantee a refund. We may verify Credit usage records before deciding whether a refund request is eligible. Cancelling a subscription stops future renewals. It does not refund payments already made.

3. Content

Content found on or through this Service are the property of kanaries data inc. or used with permission. You may not distribute, modify, transmit, reuse, download, repost, copy, or use said Content, whether in whole or in part, for commercial purposes or for personal gain, without express advance written permission from us. Your Inputs and AI-generated Outputs are governed by Section 3.1 instead of this paragraph.

3.1 Your Inputs and AI-Generated Outputs

"Inputs" are the prompts, files, images, data, and other material you submit to the Service. "Outputs" are the content generated by the Service's AI features in response to your Inputs, such as animations, images, videos, SVG files, code, and text.

Inputs. You keep whatever rights you already have in your Inputs. You represent that you have all rights needed to submit your Inputs and to let us process them as described in these Terms and our Privacy Policy. Nothing in this Section takes away rights you already hold in material you submit, even if that material appears in an Output.

Outputs generated with a free plan. You do not own, and do not acquire any copyright or other intellectual property right in, any Output generated with a free plan, free quota, free trial, or free Credits ("Free Outputs"). To the extent any such rights exist, as between you and us, they belong to kanaries data inc. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use Free Outputs for personal, non-commercial purposes.

Outputs generated with a paid plan. Whether an Output generated with a paid plan or paid Credits is protected by copyright, and who holds any rights in it, is determined by the laws that apply to you, including laws that govern AI-generated content. In some jurisdictions, content generated by AI cannot be protected by copyright. To the extent those laws allow rights in such an Output to belong to you, we do not claim them against you, as long as you comply with these Terms.

No guarantees about Outputs. We do not represent or warrant that any Output is protected by copyright or any other intellectual property right, that you will hold any such right, that an Output is unique, or that an Output does not infringe the rights of others. Other users may receive similar or identical Outputs. You are responsible for your Inputs, for your use of Outputs, and for determining whether your use complies with the laws that apply to you.

License to us. You grant us a worldwide, non-exclusive, royalty-free license to host, store, copy, process, transmit, and display your Inputs and Outputs as needed to provide, maintain, secure, support, and improve the Service and to comply with the law. This license survives the deletion of your account to the extent we retain information as described in our Privacy Policy.

4. Accounts

When you create an account with us, you guarantee that the information you provide us is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account on our Service.

You may request deletion of your account by emailing support@vizgpt.ai. We will handle your request within the time described in our Privacy Policy (opens in a new tab), which also lists the records we keep after an account is deleted. Deleting your account does not entitle you to a refund except as provided in Section 2.1, and any unused Credits and remaining subscription time end when the account is deleted.

5. Intellectual Property

The Service and its original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of kanaries data inc. and its licensors.

6. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

7. Indemnification

You agree to defend, indemnify, and hold harmless kanaries data inc. and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password, or b) a breach of these Terms.

8. Limitation Of Liability

In no event shall kanaries data inc., nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

9. Disclaimer

Your use of the Service is at your sole risk.

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

11. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will post the updated Terms on this page and change the "Last Updated" date above. If a revision is material, we will make reasonable efforts to provide notice before the new terms take effect, for example by email or a notice on the Service. What constitutes a material change will be determined at our sole discretion. Your continued use of the Service after the new terms take effect means you accept them.
